Dyan Williams has been imperative in our I-130, I-485 and I-601 journey. I came to the USA in November 2019, and had sought out a B-2 Visa to do so. I needed the waiver of inadmissibility due to something from my past back in 2007. Upon entering the USA, I knew it would be a short 4-5 month stay with friends before returning home to Australia, however, the pandemic happened and my flights were canceled. During the time I was here, I applied for an I-539N extension and was granted a stay until November 2020. During that time, I met my now husband, whom I had known online for many years prior to meeting him in person. After spending so many months together, and still not knowing when I would be able to return home to Australia due to pandemic restrictions, he and I decided that we wanted to share a life together and took the steps to make that happen. Part of that process was finding an immigration lawyer that had the right expertise in order to assist us during that journey. Neither my partner or I have ever attempted such a feat, and had no idea where to begin, how to submit any of the applications, nor what was required of us. Dyan was referred to us by a friend. In May 2023 we did a joint filing for applications I-130 and the I-485. She had successfully been assisting us remotely this entire time without issue. However, we were not able to find a lawyer experienced enough or available on that date to meet us at the interview. I personally also felt that Dyan knew our case the best as she had been with us since the beginning and it would be better to have Dyan on the phone at the interview (if she was willing), rather than someone new, or no lawyer at all. Due to being unable to find a suitable lawyer in our area, Dyan went above and beyond to guide us to a resolution for this problem. Dyan assisted by clearing her schedule in order to be there for when the USCIS officer would call. The USCIS officer was also kind enough to call Dyan for us while I had my interview. Dyan worked diligently to prepare our I-601 (Waiver of grounds of inadmissibility) application and submitted it prior to my interview to ensure that the USCIS office had all the information they needed about my case. I had a permanent bar to the U.S. under INA 212(a)(2)(A)(i)(I), and had previously gotten the 212(d)(3) waiver for the visitor visa. But to obtain the green card, I needed the I-601 waiver, which is harder to get. I had to convince USCIS that my indiscretions had occurred more than 15 years ago, I was fully rehabilitated, and I posed no risk of harm to the welfare of the United States OR my U.S. citizen spouse would face extreme hardship if I was not admitted to the United States. Dyan helped us prove that I qualified for the I-601 waiver not just on one of the eligibility grounds, but on BOTH of them. In February 2025, my I-485 and I-601 applications were both approved.
