Brittany Gates took my case on 12/4/24. Prior to signing a $2000 retainer I asked Ms. Gates if the other party (Petitioner) would be responsible for my attorney fees? She replied, “ The award of attorney fees is provided for by statute. If it shown that the allegations did not occur by a preponderance of the evidence, the responding party may be awarded fees.” I knew the allegations against me were false so I paid the retainer. The hearing was on 12/9/24. The case against me was dismissed because the petitioner did not prove the evidence in the petition by a preponderance of the evidence. I asked Ms. Gates several times since the hearing if I was going to recoup my attorney fees. She did not provide a response. On 1/28/25 I wrote a final note to Ms. Gates, “I had to hire another attorney to figure out why you are ignoring my communications about the court assessing all court costs, including attorney fees, against the petitioner. The dismissal is attached and you should have brought this to the judge’s attention during the hearing. Since you failed to do so, it appears as though I will not be receiving the attorney fees from the petitioner. Your behavior is completely unethical and your lack of communication is inexcusable. I will be writing a public review, and I will also be contacting the attorney who referred me to you to ensure he does not refer you any additional clients.” FINALLY a response: 1/28/25 Ms. Gates, “I would ask that you refrain from reviews and allow me to issue a partial reimbursement.” 1/31/25 I wrote, “Several days ago you asked that I refrain from reviews and allow you to issue a partial reimbursement. I asked you what you are proposing and now I haven’t heard from you again? If you are serious, I expect I’ll hear from you today.” As of 2/3/25 I still have not received a response from Ms. Gates. Needless to say this was a time consuming and frustrating experience. I only gave her two stars because the case was dismissed - which I knew would happen from the start.
