Jan 06, 2025 · Stephanie MaloneI hired Joe in late January 2024 and he promptly sent his notice of appearance and requested a hearing on my behalf. In following up, he learned SSA basically lost my application. With his guidance, I finally straightened things out in late April. In updating Joe, we agreed I'd send the letter confirming things were back on track. He also recommended switching my case to Access Disability since staff could help manage any ongoing wonkiness. Because he assured me he would remain my attorney, I agreed. When I received the SSA letter, I promptly sent it as promised. Yet staff reached out a week later asking after it. I responded that I already sent it and trusted that staff was doing as they said and requesting my hearing. If staff felt the most recent letter I sent wasn't the correct letter, they had an obligation to check with Joe and/or immediately let me know. Further, they should’ve independently seen the only other relevant letter—my denial—had been in my file since January. Instead, I was met with radio silence until the firm reached out about Joe leaving less than 2 months after moving my case. Since my goal was to remain with Joe and not Access Disability, I attempted to contact him directly to no avail. I began seeking other firms, but didn’t know I needed to act with any urgency because I understood Joe and his staff to be on top of requesting my hearing. Then, in early August—THREE months late—I get notified Access Disability JUST requested my hearing. I should be approx. 1/2 - 1/3 through waiting for my hearing that can take 6-9 months to get scheduled. But because Joe, while still with Access Disability, disregarded his obligations, I’m just now starting the waiting game. Interestingly, it was only after I fired Access Disability and they alerted Joe (who was no longer with the firm) that he finally reached out ready to go despite no longer representing me. Although Joe is knowledgeable, he’s also incapable of adequately or diligently handling my matter. He and Access Disability have left me more stressed and overwhelmed than when I was bumbling on my own.

Through Atticus, they found me JDisability, I was able to speak with Mr. Duerst on numerous occasions. I feel my benefits could have been in jeopardy without the thoroughness of J.Duerst and the efforts of Atticus. Thanks so much to everyone involved.

It took some time to get my husband on disability and there was some crazy circumstances however Joe was able to secure payment for my husband and our children. I can’t say thank you enough! He was always available, easy to understand, and most importantly cared more about the person than the money. That is rare which is why I’m telling you to stop looking and book or call him immediately!
