Elder Law: This specialized field involves counseling and representing older persons and their families on a wide range of legal issues. Services typically include long-term care planning, which often involves strategies for navigating the complex public benefits system (such as Medicaid) to cover the costs of nursing home or assisted living care. Elder Law also encompasses surrogate decision-making, where the firm helps clients establish legal documents like powers of attorney to designate trusted individuals to make financial and healthcare decisions on their behalf if they become incapacitated. This area is vital for proactive planning to protect assets and ensure quality care in later life.
Estate Planning: Prudent Planning Legal, PLLC assists clients in the process of planning for the management and distribution of their assets upon their death or incapacity. This includes drafting essential legal documents such as Wills, Living Wills (also known as Advance Directives or Healthcare Directives), and Durable Powers of Attorney. The goal is to ensure that clients' wishes are honored, their loved ones are provided for, and potential probate complexities or tax implications are minimized.
Probate: This is the legal process of validating a will and administering an estate after a person's death. Prudent Planning Legal, PLLC assists heirs and personal representatives in navigating the probate court system, ensuring that debts are settled, assets are properly collected, and inheritances are distributed according to the deceased's will or state law. Their aim is to make the inheritance process as smooth and stress-free as possible for the heirs.
The firm highlights their passion for helping clients protect their future through careful legal planning. They emphasize that each client is a "whole, complex individual, rather than just a faceless legal issue," signifying a personalized approach to their services.
A significant feature, highlighted by a positive client review, is Bryana Cross Bean's involvement on the board of the Washington State Elder Law Attorneys, where she also served a year as their president. This demonstrates a high level of expertise, leadership, and recognition within the elder law community, suggesting a deep understanding of the intricacies and evolving landscape of elder law. The firm also actively gives back to the community by providing free estate and long-term care planning presentations to seniors at various senior centers and assisted-living facilities in Pierce County, showcasing a commitment to education and community engagement. They are described as "super approachable" and take the time to listen, providing "effective and straightforward methods."
However, the available customer reviews present a mixed perspective, particularly concerning the ethical considerations in elder law. One review praises the firm for their expertise, especially for helping with aging parents and ensuring family documents are in order, reinforcing the firm's stated mission. Conversely, another review expresses significant concern and criticism, alleging that the firm assisted an elderly person with alcohol-induced dementia in rewriting a living trust, despite the client purportedly not being of sound mind and having been previously scammed. This reviewer explicitly states, "Shame on this law office for helping take advantage of an elderly person," and further adds, "They do not have the skills or education to test their clients for dementia: they’re attorneys, not doctors. These people are money-hungry just like all attorneys. Stay away from this place."
This critical feedback highlights a crucial ethical and practical challenge in elder law: determining a client's mental capacity. While attorneys are not medical professionals and cannot diagnose dementia, they have a professional obligation to assess a client's capacity to understand and execute legal documents. This requires careful judgment, and in complex cases, may involve recommending a medical evaluation. The diverging reviews underscore the importance of this aspect in elder law practice and present a point of consideration for potential clients.
The positive review emphasizes the firm's ability to help families with proactive planning for aging parents and securing essential legal documents, which aligns with the firm's stated passion for helping clients protect their future. The firm's commitment to community outreach through free presentations further promotes their dedication to educating and serving the senior population. Their approach is described as "super approachable" and client-focused, which can be very appealing to individuals seeking a compassionate and understanding legal partner.
However, potential clients should also be aware of the serious concerns raised in the negative review regarding client capacity and ethical conduct in cases involving vulnerable elderly individuals. This particular feedback, while a single data point, points to a potential area of scrutiny for those considering their services, especially for cases involving elderly family members with diminished cognitive abilities. When evaluating a firm through a "Lawyers Near Me" platform, it is often advisable to consider the full spectrum of available feedback and to discuss any concerns directly with the firm.

May 10, 2024 · Stephen B.My father has alcohol-induced dementia and has been scammed for over $100k. I was his power of attorney and because he is being influenced by other people and refused to get a dementia workup, I tried to get him help. He lashed out and hired this woman to rewrite his living trust even though he is not of sound mind. Shame on this law office for helping take advantage of an elderly person. Update: They do not have the skills or education to test their clients for dementia: they’re attorneys, not doctors. These people are money-hungry just like all attorneys. Stay away from this place.
