This guy calls himself a Qualified Intermediary I'd say the only thing he is qualified for is to clean a toilet and maybe not even that. I am doing a 1031 for my first time with over $1 million This guy would not return an email text or calls then finally did. His assistant was so incompetent that she had to send the paperwork 3 times and could not give the correct answers and was so rude because I needed help completing the complicated paperwork that they should have completed first. Gave me the wrong instructions and in final could not answer a simple question. I feel i just avoided a thief and my lifetime work to get to this level. AVOID

Smith Gregory R Introduce

For real estate investors across Ohio, navigating the intricacies of tax regulations can be as complex as finding the perfect property. One powerful tool available for deferring capital gains taxes on investment property sales is the 1031 exchange, formally known as a like-kind exchange under Section 1031 of the U.S. Internal Revenue Code. Executing a 1031 exchange properly requires a specific type of professional assistance, particularly from a Qualified Intermediary (QI). In Columbus, Ohio, individuals and entities looking to utilize this tax-deferral strategy might consider services offered by professionals such as Gregory R. Smith.

This article aims to provide a clear, engaging, and informative overview related to the services of Gregory R. Smith, specifically focusing on his role as a Qualified Intermediary for 1031 exchanges, tailored for local users in Ohio. We will delve into what a Qualified Intermediary does, the importance of this role in a 1031 exchange, his convenient office location in Columbus, and key considerations for those exploring this tax strategy. Our goal is to offer a professional yet approachable perspective for Ohioans seeking to understand and potentially utilize 1031 exchanges for their real estate investments.

A Qualified Intermediary (QI), also known as an exchange facilitator or accommodator, plays a crucial role in a 1031 exchange. The QI holds the proceeds from the sale of the relinquished property and uses those funds to purchase the replacement property, ensuring that the taxpayer never has direct control of the funds. This is a critical requirement for a valid 1031 exchange to defer capital gains taxes. Without a QI, the transaction would be considered a taxable sale. The QI also prepares the necessary exchange documents, including the Exchange Agreement, Assignment of Purchase and Sale Agreement, and Notice of Assignment.

The process of a 1031 exchange is highly structured and time-sensitive. Once a relinquished property is sold, the investor has 45 days to identify potential replacement properties and 180 days to close on the replacement property. Any misstep in this process can invalidate the exchange and trigger immediate tax liability. Therefore, selecting a knowledgeable and responsive Qualified Intermediary is paramount to the success of a 1031 exchange. While specific and detailed public information about Gregory R. Smith's full range of services as a lawyer is not widely available, his association with the role of a Qualified Intermediary suggests a focus on real estate transactions and tax planning for investors.

Location and Accessibility

Gregory R. Smith's office is conveniently located in the heart of Ohio's capital, Columbus, making it accessible for real estate investors and businesses throughout the state. His professional address is:

65 E State St #1800, Columbus, OH 43215, USA

This prime downtown Columbus location places his office in a central business district, often indicating proximity to financial institutions, other legal services, and key governmental offices. For those traveling to the office, downtown Columbus offers various transportation options. Numerous parking garages and metered street parking are typically available in the vicinity, though it's always advisable to check current availability and rates, especially during peak hours. The Central Ohio Transit Authority (COTA) bus system also serves the downtown area extensively, providing convenient public transit access. The strategic location in the state capital ensures that individuals and businesses from across Ohio can readily access services related to 1031 exchanges, facilitating in-person consultations and the necessary document exchanges for these time-sensitive transactions.

Services Offered

Based on the provided information indicating Gregory R. Smith's role as a "Qualified Intermediary," his primary services would revolve around facilitating 1031 like-kind exchanges for real estate investors. While he is also identified as a "lawyer," the specific legal services outside of the Qualified Intermediary role are not detailed.

The core services offered by a Qualified Intermediary like Gregory R. Smith in the context of a 1031 exchange include:

  • Structuring the 1031 Exchange: Advising the investor on the proper structure of the exchange to ensure it meets IRS guidelines for tax deferral. This involves understanding the specific type of exchange (e.g., forward, reverse, construction).
  • Preparing Exchange Documents: Drafting and executing all necessary legal documents required for a valid 1031 exchange, including the Exchange Agreement, Assignment of Purchase and Sale Agreement, and Notice of Assignment. These documents are crucial for demonstrating that the investor does not have constructive receipt of the proceeds.
  • Holding Exchange Funds: Receiving and holding the proceeds from the sale of the relinquished property in a segregated account. The QI ensures these funds are not accessible by the taxpayer during the exchange period, which is a critical IRS requirement.
  • Facilitating Property Acquisition: Directing the use of the exchange funds to purchase the identified replacement property, ensuring the transaction adheres to the strict timelines and rules of a 1031 exchange.
  • Guidance on Identification Rules: Providing clear instructions and ensuring compliance with the 45-day identification period rules (e.g., three-property rule, 200% rule, 95% rule) for replacement properties.
  • Adherence to Exchange Timelines: Monitoring and ensuring strict adherence to both the 45-day identification period and the 180-day exchange period, as any deviation can invalidate the tax deferral.
  • Consultation on Exchange Requirements: Offering expertise and consultation on the technical requirements of Section 1031 of the Internal Revenue Code, helping investors understand the nuances of "like-kind" property and other crucial rules.

As a "lawyer" who acts as a Qualified Intermediary, Gregory R. Smith may also provide additional legal counsel related to real estate transactions, property law, or tax implications beyond the immediate scope of the 1031 exchange itself, though this would need to be confirmed directly with his office.

Features / Highlights

When considering Gregory R. Smith for 1031 exchange services, several features and highlights are particularly relevant for Ohio real estate investors:

  • Specialized Expertise in 1031 Exchanges: His role as a Qualified Intermediary specifically targets a niche but highly valuable area of real estate law and tax planning. This specialization indicates focused knowledge essential for complex 1031 transactions.
  • IRS Compliance Focus: A primary function of a Qualified Intermediary is to ensure strict adherence to IRS Section 1031 regulations, which is critical for the successful deferral of capital gains taxes. This focus on compliance is a key benefit.
  • Central Columbus Location: Situated in downtown Columbus, his office is conveniently located for investors across Ohio, providing accessible in-person consultation and document handling for time-sensitive exchange processes.
  • Role in Tax Deferral Strategy: For real estate investors, the ability to defer capital gains taxes through a properly executed 1031 exchange is a significant financial strategy, and the QI is an indispensable part of that process.
  • Handling of Exchange Funds: The QI's responsibility for holding exchange funds in a secure, segregated account during the transaction period provides a necessary layer of protection and compliance for the investor.
  • Professional Guidance: While the provided review indicates a negative experience regarding communication and assistance with paperwork, the intended feature of a Qualified Intermediary service is to provide professional guidance and ensure correct procedures are followed for successful tax deferral. This is the inherent value proposition of such a service.
Promotions or Special Offers

As a Qualified Intermediary and legal professional, Gregory R. Smith's services are based on facilitating complex, IRS-regulated transactions rather than offering typical commercial "promotions" or "special offers." Fees for Qualified Intermediary services are generally structured based on the complexity of the exchange, the number of properties involved, and the overall transaction value.

However, the "offer" and significant value proposition for real estate investors considering a 1031 exchange through Gregory R. Smith can be viewed through the following benefits:

  • Potential for Substantial Tax Deferral: The primary benefit of using a Qualified Intermediary is the legal deferral of capital gains taxes on investment property sales, which can amount to significant savings for investors. This is the core "offer" of the service itself.
  • Ensuring IRS Compliance: The QI's expertise is crucial for ensuring that the exchange adheres to all stringent IRS Section 1031 rules, thereby avoiding costly tax penalties and ensuring the deferral is legitimate.
  • Protection of Exchange Funds: The QI holds the exchange funds in a secure, segregated account, which provides a layer of protection for the investor’s capital during the transaction period.

For prospective clients, the true value lies in the specialized knowledge and procedural execution required to successfully complete a 1031 exchange and realize its tax benefits. It is always recommended to contact Gregory R. Smith's office directly to discuss your specific 1031 exchange needs and to inquire about his service fees and process. Due diligence and clear communication about expectations for service, especially regarding complex paperwork and responsiveness, are crucial.
