Operating within the "Lawyers Near Me" category, Joseph M. Proietta, Esq., and his firm, 401-ElderLaw, are dedicated to addressing the unique legal needs of seniors, persons with disabilities, and their families. This highly specialized area of law encompasses a diverse range of issues, including traditional estate planning, the drafting of wills and trusts, adult guardianships, asset protection, and meticulous planning for long-term care, including Medicaid applications for assisted living facilities or nursing homes. They also handle probate matters and Superior Court litigation related to these areas. Joseph M. Proietta is licensed to practice law in Rhode Island, Massachusetts, and in the U.S. District Court for the District of Rhode Island, extending his reach to serve a broader regional clientele.

The environment at 401-ElderLaw, as suggested by positive client feedback, aims to provide excellent service and a supportive atmosphere. One client lauded the "Excellent service!" and stated that "Joe went over and above to meet our needs," highly recommending "Joe & his top-notch team!" and giving an "A+ all around!" This indicates a professional and dedicated team that strives to meet client expectations and provide comprehensive support. The firm's focus on elder law inherently suggests an environment built on compassion, understanding, and patience, given the sensitive nature of the legal issues involved. However, it is also important to consider all available feedback.

The services offered by Joseph M. Proietta, Esq., are designed to provide guidance and peace of mind for clients navigating the complexities of elder law. This includes helping individuals preserve personal wealth, minimize tax liabilities, and ensure their wishes are honored regarding their assets and healthcare decisions. They provide customized advice for established clients on estate and elder law planning, and for younger couples/families on education funding and saving for retirement. The firm's team assists with establishing various types of trusts (including irrevocable and asset protection trusts), preparing wills, and handling advanced health care directives and powers of attorney. Their expertise also extends to emergency long-term care and Medicaid planning, often involving customized asset protection solutions to safeguard hard-earned assets from nursing home care costs.

A significant feature of Joseph M. Proietta's practice is his involvement in guardianship and conservatorship cases. The firm represents clients seeking guardianship and conservatorship of relatives who can no longer manage their personal or financial affairs, and they assist family members in fulfilling the duties imposed by these roles. In situations where no family member is willing or available, the firm's attorneys may act as guardian or conservator on a temporary or permanent basis. Joseph M. Proietta is a graduate of the Roger Williams University School of Law, where he was a member of the Law Review, signifying a strong academic foundation in legal principles.

However, it is crucial to present an objective view, and one review raises a serious concern regarding guardianship oversight. This client stated, "In District Court yesterday I put Mr. Proietta under oath and asked him if he had ever visited the elderly gentleman who he is guardian of. He sheepishly answered 'No' not once in his 8 months guadianship. Neglect? I will not answer. A lack of simple human decency and compassion, obviously yes. As a friend I am unable to visit and as his guardian Joseph is unwilling." This specific review highlights a critical point of contention regarding a guardian's responsibilities and client interaction. It suggests a potential disconnect between the expectation of direct client engagement, especially for vulnerable individuals under guardianship, and the reality experienced by this reviewer. While one positive review extols "excellent service," this negative feedback regarding a specific aspect of his guardianship practice warrants consideration for potential clients.

Promotional information for 401-ElderLaw emphasizes their mission to help seniors and their families plan for the future, stating their expertise in handling a diverse range of issues affecting seniors and persons with disabilities. The firm's website mentions a team, including paralegals like Tracy R. Mitchell, who support the lawyers on estate planning, probate, and Medicaid matters, and manage day-to-day operations. This indicates a structured approach to client service. Joseph M. Proietta founded his firm in 2003 with the goal of assisting the elderly and their families, indicating a long-standing commitment to this specialized field. His firm also appears to have other attorneys, such as Gwendolyn M. Hancock, Esq., an associate licensed in Rhode Island and Massachusetts, further building the firm's capacity.

In summary, Joseph M. Proietta, Esq., owner of 401-ElderLaw, located at 155 S Main St #302, Providence, RI, offers specialized legal services within the "Lawyers Near Me" category, primarily focusing on elder law, estate planning, and probate matters. Services include wills, trusts, Medicaid planning, asset protection, and guardianship. While some clients have lauded his "excellent service" and ability to "go over and above," a significant review raises concerns about direct client visits and a perceived lack of compassion in a guardianship role. Prospective clients seeking elder law services should consider both the positive testimonials highlighting comprehensive legal support and the specific concerns regarding guardian oversight, to make an informed decision about their legal representation.

Both Joe and Gwen are the very best at what they do. I could not ask for better service or advice. I have the same trust in Proietta Law as my father did!
