Specialized Services in Elder Law and Estate Planning

Reid M.E. McCarthy has carved out a niche as a prominent Elder Law attorney. His practice areas are specifically tailored to address the unique legal and financial challenges faced by seniors and their families. His services include, but are not limited to:

  • Elder Law: This comprehensive area involves assisting seniors with a wide range of legal issues, including long-term care planning, asset protection, and navigating government benefits like Medicaid.
  • Estate Planning: While traditional estate planning often focuses on post-death asset distribution, Mr. McCarthy emphasizes planning for incapacity, nursing care, and pre-death family issues. This includes drafting wills, trusts, powers of attorney, and other documents to ensure clients' wishes are honored and their families are prepared for potential future challenges.
  • Medicaid Planning: A critical service for many seniors, this involves strategies to help clients qualify for Medicaid benefits to cover long-term care costs while preserving as many assets as legally possible.
  • Long-Term Care Planning: Advising families on options for long-term care, such as assisted living, nursing homes, and in-home care, and the financial implications of each.
  • Probate Avoidance: Structuring estate plans to minimize or avoid the probate process, which can be time-consuming and costly.
  • Assisted Living Guidance: Providing counsel on the transition to assisted living facilities, including financial considerations and application assistance, as evidenced by client testimonials.
  • Incapacity Planning: Helping clients prepare for situations where they may no longer be able to make decisions for themselves, through durable powers of attorney and patient advocate designations.

Mr. McCarthy's expertise in these areas is crucial for families seeking to protect their loved ones' assets, ensure proper care, and alleviate the stress associated with aging and end-of-life planning.

My parents went to Reid in 2006, shortly after they moved to Ann Arbor. He set up an estate plan for them, and also had a frank talk about when to know if it's time for assisted living, and how to plan for the possibility. My parents understood all that he said, and agreed that eventually assisted living might make sense for them. In 2013, my father died after a short stint in the hospital, and Reid helped me with the necessary paperwork, and the ways to handle my father's part of the estate to my mother's advantage. Recently my mother's health has been declining (age 92), and I was trying to keep her home with a combination of in-home care, and me filling in. The cost for part-time care was unsustainable for her, even with me taking over 17 hours a day. I called Reid in desperation, explaining her health issues, asking about her options, and could she even afford assisted living. He was so helpful in gently reassuring me that yes, she could afford it, and furthermore it was definitely time for her to move and for me to get my life back. He confirmed that my choice of an assisted living place was excellent, and made suggestions about how to fill out the financial part of the application. Reid was right - Mom moved into her assisted living apartment last week and is now happier than she's been in a long time, with all the activities and care provided. Meantime my worries for her have dissipated. In a nutshell, Reid has the professional expertise to manage elder law for families, but he also has life experience to help guide families through very difficult situations with clarity and compassion. In our particular case, he was so much more helpful than the social worker assigned to my mother's case during her stint in rehab. And by the way, Reid never charged me for this recent advice concerning my mother and assisted living.

Reid has been my family attorney through my grandparents, and my parents. He has always been there to ask questions when my sister and I were going through the trust my parents put together for us when they passed. Reid was the one that put it together for them. He’s helped with the legal talk of probate, selling of the parents house. And other such things when my father unexpectedly passed, and changing my mother’s location of adult living area, until she to passed. I am thankful that Reid was there for us through the process and still is when ever we have questions he is there to answer.

Currently working with Reid. I plan on using Reid law to prepare for my own end of life plan. My grandparents used him as well as my dad. These are not easy things to do, Reid has made everything less stressful. He is a down to earth person that will talk to you and help you understand. He is personable, reliable and helpful through out the entire process.

Reid was extremely helpful and compassionate while I was going through putting my mother into a nursing home with dementia. He helped me greatly save money. I would recommend him highly.
